Welcome to Salty Dog Crew™. These Terms & Conditions (“Terms”) govern your use of our website, mobile application, and salt delivery services (collectively, the “Services”) operated by Salty Dog Crew™ (“we,” “us,” or “our”). By accessing or using our Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and reside within one of our active service areas to use our Services. By creating an account, you represent that you meet these requirements.

2. Account Registration

To use our Services, you must create an account with accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

3. Service Description

Salty Dog Crew™ delivers water softener salt, ice melt, pool salt, and related products to residential and commercial addresses. Services are provided by independently owned and operated franchise locations. Service availability, product selection, and pricing may vary by location.

4. Subscriptions

• Monthly subscription: A recurring monthly fee that includes delivery service, salt level monitoring, and softener filling by our technicians. The cost of salt products is billed separately per delivery.
• On-demand orders: You may also place one-time orders without a subscription. Delivery fees and pricing may differ from subscription rates.
• Cancellation: You may cancel your subscription at any time through the app or by contacting us. Cancellation takes effect at the end of the current billing cycle. No cancellation fees apply.
• Pausing: You may pause your subscription at any time. No deliveries or charges will occur while paused.

5. Pricing and Payment

• All prices are listed in US dollars and may vary by franchise location.
• Subscription fees are billed monthly to your payment method on file.
• Product costs are charged per delivery based on the items and quantities delivered.
• Applicable sales tax is calculated automatically based on your delivery address.
• Payment is processed securely through Stripe. We do not store your payment card details on our servers.
• We reserve the right to adjust pricing with reasonable notice. Active subscribers will be notified at least 30 days before any price change takes effect.

6. Delivery

• We will make reasonable efforts to deliver on your scheduled date. Delivery windows are approximate and may be affected by weather, volume, or route conditions.
• You are responsible for providing accurate delivery instructions and ensuring safe access to the delivery location.
• If we are unable to complete a delivery due to access issues (locked gate, aggressive animal, unsafe conditions), we will notify you and attempt to reschedule.
• Risk of loss passes to you upon delivery to the specified location.

7. Refunds and Returns

• If you receive damaged or incorrect products, contact us within 48 hours for a replacement or refund.
• Subscription fees are non-refundable for the current billing cycle once the cycle has started.
• Unopened, undamaged bags of salt may be returned at the next scheduled delivery for credit, subject to your franchise’s return policy.

8. Your Responsibilities

• Provide accurate account and delivery information.
• Maintain a valid payment method on your account.
• Ensure safe and accessible delivery conditions for our technicians.
• Use the Services only for lawful purposes.

9. Intellectual Property

All content, trademarks, logos, and intellectual property associated with Salty Dog Crew™ are our property or licensed to us. You may not reproduce, distribute, or create derivative works without our written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Salty Dog Crew™ and its franchise operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Salty Dog Crew™, its franchise operators, officers, employees, and agents from any claims, losses, or damages arising from your use of the Services or violation of these Terms.

12. Dispute Resolution

Any disputes arising from these Terms or the Services shall be resolved through binding arbitration in the State of Utah, in accordance with the rules of the American Arbitration Association. You waive the right to participate in class action lawsuits or class-wide arbitration.

13. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict of law principles.
